Vango Art supports different ways of acquiring and using artwork. The licensing terms attached to an artwork are determined by the artist and are displayed as part of the applicable artwork listing or acquisition terms.
The Artist Sets the Licensing Terms
Artists determine the licensing option available for their work and the applicable price.
Depending on the artwork, an artist may offer options such as:
- Personal use
- Commercial use
- Exclusive licensing
- Other specific usage rights defined by the artist
The exact rights granted depend on the license selected and the terms presented with the artwork.
What a Collector Acquires
When you purchase or license an artwork, you acquire only the rights expressly included in the applicable listing and licensing terms.
Purchasing an artwork or license does not automatically transfer copyright or other intellectual-property rights to the collector unless the applicable agreement expressly provides otherwise.
Copyright Remains With the Artist
Unless expressly transferred through a separate written agreement, the artist retains copyright and ownership of their intellectual property.
A license generally gives the collector permission to use the artwork in the specific manner defined by the applicable licensing terms.
Exclusive Licensing
Where an artist offers an exclusive license, the scope, duration, territory, permitted use, and any other limitations are determined by the terms attached to that specific license.
Collectors should review those terms carefully before completing an acquisition.
Physical Artwork vs. Copyright
Acquiring a physical artwork does not, by itself, transfer the copyright in the underlying artwork.
Similarly, acquiring a print or other physical reproduction does not automatically grant unrestricted rights to reproduce, distribute, modify, or commercially exploit the artwork.
The collector’s permitted use is determined by the applicable acquisition and licensing terms.
Before You Acquire
Before completing an acquisition, review:
- The artwork description
- The artist’s listed price
- The available format
- The licensing option
- The permitted use
- Any limitations or restrictions
- Whether the license is exclusive or non-exclusive
- Any additional terms provided by the artist
If you require rights beyond those offered with the artwork, contact the artist through the appropriate Platform channel to discuss whether additional licensing is available.
A Clear Record of Rights
Vango Art maintains applicable transaction and provenance records associated with completed acquisitions. The specific rights granted to a collector remain governed by the licensing terms applicable to that acquisition.
